Check-list for buying a Residential Flat

As the above quote rightly emphasised, a home is a very special place on everyone's life.So it is very important to choose a right home with required amenities, in accordance to your need.I am not going to write about the factors like right location, connectivity to Schools/Hospitals,proper ventilation, etc.as it is presumed that you know what you want for a comfortable living.

I am here going to confine myself with the requirements that you need in a legal sense.

Before buying a flat from the builder, pls ask for the following documents -
  • Title Deed 
  • Parent Document
  • Development Agreement between land owner & builder, as the case may be
  • Atleast 15  years of up-to-date Encumbrance Certificate from the concerned SRO;Patta/Chitta Adangal
  • NOC;Approved Building and Floor plan from competent authority.
  • Construction Specifications, if the flat is under-construction
  • Draft Agreement of Sale.
Points to be considered -
  • Don't be in a rush.Take enough time to ensure that the ownership documents are of original one.Seek Professional opinion, if required.
  • Don't get carried on by the brand tag of the builder.Do your ground works properly.
  • Construction specifications is nothing but the quality/brand of materials that would be used for works like civil/Flooring/Painting/Electrical/Carpentary, etc
  • The agreement of sale should ideally include, apart from the regular parts of the deed, the payment schedules, construction specifications, extra amenities provided, maintenance of infrastructures, builder's liability in case of deficiency of services or delay in project completion, corpus fund, etc
  • If the construction is not completed within the prescribed period of the approved plan, the approval given by the competent authority would be elapsed.
  • In case of the flat under-construction, the buyer has to ensure that the builder complies with the  building/floor plan approved by the competent authority.
